In an uncontested divorce, both parties agree upon the various issues that must be decided. These issues include marital asset division, child custody and co-parenting arrangements, child support and spousal support, if any.

Many people opt to handle an uncontested divorce on their own, without an attorney—often because they think they can't afford one. One common legal issue I often see involves people faced with problems after handling their own uncontested divorces. Remember: just because you and your divorcing spouse agree on every issue does not mean the choices you outline in your divorce agreement will be approved by the court. For instance, people may negotiate a divorce settlement agreement in which certain issues are “traded off.” If these trade offs are not allowed by Nevada law, they could be removed from your final divorce decree by the judge. They could even be partially removed later, taking out what you traded for, but leaving in what you “traded away.”

I offer experienced representation in divorce-related matters such as the following:

Child custody - I represent divorced and unmarried parents in child custody or visitation disputes and provide representation in post-divorce motions to modify custody.

Marital property division - I handle the division of marital assets and debt, including pensions, benefits, retirement accounts such as IRAs and 401(k) plans, stock options, QDROs and family-owned businesses.

Child support - I represent clients who will be receiving child support as well as those who will be paying. Child support is determined based upon statutory guidelines, but it is possible to deviate from the guidelines in some situations. I also handle modification of earlier child support orders.

Spousal support - I represent clients who are seeking spousal support (“alimony”) or whose spouse may be eligible for temporary or permanent spousal maintenance.

Military divorce issues - I represent military clients who need to enforce divorce judgments from other states now that they have moved to Nevada.
